1️⃣ KENYA IS ABOUT TO PRICE A LICENCE OFF YOUR TURNOVER

The Senate Committee on Delegated Legislation took evidence on Thursday 17 September from nine industry bodies on the Tourism (Tourism Enterprises) Regulations 2026 — Legal Notice No. 127 of 2026, published 10 July and tabled in the Senate on 17 July (People Daily, 18 September 2026). The regime licences, classifies and grades hotels, restaurants, tour operators, travel agents, tourist transport, air charter and nature-based enterprises under the Tourism Regulatory Authority. Licence fees are banded on annual gross revenue — reported from KSh 16,000 for a new or sub-KSh 2m restaurant up to KSh 250,000 (The Kenya Times, 18 September 2026). Specified offences carry up to KSh 1m, six months, or both.

WHAT EVERYONE IS MISSING
Kenya already charges 2% of gross sales on accommodation, food and drink as the Tourism Levy (Tourism Fund). Band a licence on gross revenue too and you have a second turnover charge wearing a licence's clothes. But the fee is not the winnable argument. The associations also told the committee they were not consulted before the regulations were drafted — a public-participation defect. That is the ground on which Kenyan instruments actually get annulled, and it is on a clock: under the Statutory Instruments Act No. 23 of 2013, s.15, the committee must report within 28 sitting days of referral. Chair Sen. Mwenda Gataya (Tharaka Nithi) put it plainly: the committee will decide "whether to annul or accede to the Regulations."

🎯 So what: Count your licensable entities before you budget one fee — a lodge with a transport arm and a tour-operating arm is three applications, not one. Then get a written submission to the committee naming the public-participation defect specifically. Verbal evidence on Thursday is not a filing.
